Horatio and Tripp are standing over the dead body of Jay Fisher, a known drug kingpin; there’s a loud crash and Johnny Nixon, a small time drug dealer, comes crashing through the skylight.  Nixon denies he had anything to do with the murder of Fisher; he claims he was making a buy when he heard Fisher and someone else arguing over drug territory and then heard gunshots.  He also informs Horatio that Delko’s been buying pot from him.  Horatio has him arrested.  Delko admits to Horatio that he has been buying marijuana from Nixon and Horatio assures him there will be an investigation.  Stetler takes Delko in for questioning and lets Horatio know he’ll be questioning his colleagues as well.  Alexx confirms that Fisher was shot 3 times.  Calleigh discovers 9 millimeter  casings at the crime scene.  Natalia tags along to the crime scene with Wolfe and they discover tempered glass fragments, which Wolfe speculates came from the getaway car.  Further investigation turns up the name Deana Walters.  Tripp visits Deana and she admits doing business with Fisher that day but swears she didn’t kill him; however, Tripp finds a 9 mil gun in her car.

Stetler questions Calleigh about Delko, but she gives him nothing.  Wolfe innocently tells Stetler he saw Delko with rolling papers.  Stetler orders Delko to get a drug test.  Calleigh’s investigation reveals that the 9 millimeter casing was not a match with Deana’s gun.   Alexx examines Wolfe’s eye and determines it’s infected, so she recommends an ophthalmologist.   Calleigh and Tripp revisit the crime scene and confirm there were two shooters; Calleigh is able to pull some prints belonging to bounty hunter Bull Merrick.  Merrick says it wasn’t him who shot Fisher, claiming it was the bail jumper he was after who shot him.   Stetler relieves Delko from duty after he tests positive for THC.  Horatio confronts Stetler about his real motive behind nailing Delko.  Wolfe and Calleigh ID the second shooter as Byron Diller, Merrick’s jumper, who is wanted for vehicular manslaughter and a D.U.I.  Wolfe and Tripp track Diller to Dr. Mansfield, a Miami-area plastic surgeon.  Merrick wants to bring Diller in so he can collect his fee. At Mansfield’s, the CSIs discover that  Merrick pulled Diller off of the doctor’s operating table and stole his boat.  They find Merrick at a local jail about to turn Diller over to authorities   Diller tells Horatio that it was Merrick that killed Fisher, not him.  Wolfe and Natalia recover the gun used to kill Fisher and conclude that Fisher was indeed the shooter.  Horatio talks with Delko’s sister, Marisol.  She tells him she has cancer and Delko has been a saint helping her through it all.   He has been taking care of all her expenses and has been getting marijuana to help with the nausea caused by the treatment.    Horatio challenges Stetler’s lack of evidence against Delko; Stetler unwillingly drops the case.
